DIVISION I CONSTRUCTION AND
DEFINITIONS
SECTION 1. CONSTRUCTION AND
SCOPE:
In the interpretation of this
ordinance affecting parks, its provisions shall be construed as
follows:
A. Any
term in the singular shall include the plural.
B. Any
term in the masculine shall include the feminine and
neuter.
C. Any
requirement or provisions of this Ordinance relating to any act shall
respectively extend to and include the causing, procuring, aiding or abetting,
directly or indirectly, of such act.
D. No
provision hereof shall make unlawful any act necessarily performed by any
officer or employee of the District in line of duty or work as such or by any
person, his agents, or employees, in the proper and necessary execution of the
terms of any agreement with the Board, except when such act endangers or
encroaches upon the rights of others as regulated by the laws of the Village of
Westmont and the State of Illinois.
SECTION 2.
DEFINITIONS
Unless otherwise expressly stated
whenever used in this Ordinance.
The following terms shall respectively mean:
A.
"Board" shall mean the Board of Commissioners of the Westmont Park
District, a Municipal Corporation,
B.
"District" shall mean the Westmont Park District, a Municipal
Corporation,
C.
"Director" shall mean the Director of the Westmont Park District.
D.
"Dusk" shall mean one (1) hour after sunset.
E.
"Park" shall mean all developments, improvements, facilities and any or
all land, minerals, waters, overhead air rights, easements and other
reservations owned, leased, controlled, or used by the District.
F.
"Permit and Reservation" shall mean and include any authorization issued
by the Director pursuant to the authority of the Board for a specified park
privilege, activity or event, or permitting the performance of a specified act
or acts in any Park.
G.
"Rules and Regulations" shall mean and include any resolution, regulation
or ordinance adopted by the Board.
H.
"Person" shall mean any
individual, company, partnership, corporation, incorporation or association, or
any combination of individuals or gathering whatsoever.
J.
"Park Patrol" shall mean any person, agent, employee, patrolman, police
officer or other law enforcement officer appointed or designated by the Board to
enforce the rules and regulations adopted by the Board.
K.
"Vehicle" shall mean any device, conveyance, or combination of
conveyances, wheeled or without wheels, propelled, towed or unpropelled that in,
around or on which, a person or thing is or may be carried, including, but not
limited to, bicycles, scooters, skateboards, mini‑bikes, motorcycles,
snowmobiles, baby strollers, sleds, trucks and automobiles.
L.
"Alcoholic Liquor" shall be as defined in the Illinois Liquor Control
Act, (235 ILCS 5/1‑3.05) as same is amended from time to time.
M.
"Controlled Substance" shall be as defined in the Illinois Controlled
Substance Act (720 ILCS 570/102) as same is amended from time to time.
N.
"Property" where used shall mean all lands, developments, improvements,
facilities, parks and equipment as owned, leased, controlled or used by the Park
District.
O.
"Overnight" shall mean the period when the park, permit or facility
officially closes or ends, until it opens the following day.
P.
"Area" shall mean a specified location within a park or
facility.
Q.
"Employee" shall mean any person on the payroll of the Westmont Park
District, employed to perform special duties and tasks as described by personnel
policy and the Board of Commissioners.
R.
"Waters" shall mean any waters or bodies of water as owned, leased or
controlled by the Park District.
S.
"Watercraft" shall mean any type of
conveyance, whether powered by sun, wind, mechanical or human energy, for travel
upon waters.
T. “District Parking
Facilities” shall mean and include any property owned, leased, controlled or
operated by the

Grill" shall mean a fabricated metal container and grill designed for the
cooking of food.
V.
“Weapon” shall mean (1) any gun,
rifle, shotgun, or other weapon, as defined in Section 921 of Title 18, United
States Code; any firearm as defined
in Section 1.1 of the Firearm Owners Identification Act; or any “weapon” as defined in Section
24-1 of the Illinois Criminal Code, including but not limited to any bludgeon,
black-jack, sling-shot, sand club, sand-bag, metal knuckles, throwing star,
knife commonly known as a switchblade that has a blade that opens automatically
by hand pressure applied to a button, spring or other device in the handle of
the knife, or ballistic knife that propels a knifelike blade as a projectile by
means of a coil spring, elastic material, or compressed gas; (2) any other
knives, brass knuckles, bows and arrows, or billy clubs; or (3) “look-alikes” of any weapon as
defined herein.
DIVISION II ‑ REGULATION OF
VEHICLES
SECTION 1. VEHICLE AND EQUIPMENT
OPERATION & ACCESS
In connection with any park or
property of the District:
A. No
person shall operate, or cause to be operated, any motorized vehicle which in
any manner does not comply with the Vehicle Code of the State of Illinois, or
other law or laws of the State of Illinois or ordinance of the Village of
Westmont, Illinois, where applicable, together with such regulations as are
contained in this ordinance and as from time to time amended, having to do with
the equipment, control, licensing, registering, and use of motorized vehicles
and/or the licensing of operators of such vehicles.
B. No
person shall operate or cause to be operated, any vehicle anywhere except on the
roads, drives and parking areas within any park, in compliance with Park
District regulations and other applicable law.
C. No
person shall operate or cause to be operated in any park, any vehicle that is
not properly licensed or permitted to be operated on the roads, streets and
highways of the State of Illinois except in such cases as authorized by the
Director, and then only in those areas specified and in accordance with
restrictions duly set forth by the Director. Vehicles subject to use in parks only as
authorized by the Director include, but are not limited to, snowmobiles,
go‑carts, trail bikes, mini‑bikes, and other such all‑terrain, off the road
vehicles.
SECTION 2. PARKING
REGULATIONS
A. Parking
Restrictions. No person shall,
shall park on District Property in violation of the following regulations:
a.
Parking is prohibited on District
Property other than in District Parking Facilities which are marked or otherwise
designated for parking of vehicles
b.
Overnight parking is prohibited on
District Property or in District Parking Facilities without a permit from the
District.
c.
Parking in District Parking
Facilities, at any time, in any manner which partially or totally blocks,
restricts, or impedes another parked vehicle, normal traffic flow, or ingress or
egress to or from a parking lot, road, driveway, sidewalk, doorway, or
recreational area is prohibited.
d.
Parking or leaving a vehicle
unattended in District Parking facilities is prohibited unless either the person
parking and leaving the vehicle, or a passenger in such vehicle, is a
participant or spectator in a District program or activity on the premises where
the vehicle is parked or left.
e.
Parking of the following described
vehicles is prohibited in District Parking Facilities:
1.
Any trailer or semi-trailer truck
that is used commercially, being defined as a vehicle designed for carrying
persons or property, for which the trailer is drawn by a motor vehicle, and so
constructed that some part of its weight and that of its load rests upon or is
carried by a road or truck tractor that is designed for drawing of the trailer;
or
2.
Any motor vehicle with a gross
vehicle weight rating of eight thousand (8,000) pounds or more;;
or
3.
Any motor vehicle that exceeds nine
(9) feet in height, including load, or twenty (20) feet in
length.
B.
Fines. The fine for a violation of all parking
restrictions established in paragraph A of this Section 2 shall be
$25.00
C.
Signs. The District’s Director is hereby
authorized to cause signs to be posted in all parking areas on District
property, which signs shall stated the parking restrictions established in
Section 2 of this Ordinance, and shall further state that vehicles parked in
violation of such restrictions may be towed by the District. Such signs shall provide
information necessary to contact the Village of Westmont Police Department to
determine the location of towed vehicles and the means of reclaiming
them.
D.
Citations.
Pursuant to the Intergovernmental Agreement entered between the District
and the Village of Westmont for enforcement of the District’s Rules and
Regulations, the Westmont Park Police Department is herby authorized to issue a
citation to any vehicle which is parked in violation of any parking restriction
established in paragraph A of this Section, which citation shall state the
violation of this Section, and the amount required to settle the violation
pursuant to the District’s Rules and Regulations. Such citation shall inform the owner of
the vehicle that upon failure to so settle, a complaint may be filed in the

Settlement Procedures. Pursuant to any citation issued pursuant
to paragraph D of this Section 2, the person cited may settle and compromise the
violation by paying to the

Towing of Illegally Parked
Vehicles. The District’s Director, or a designee,
is authorized to cause vehicles parked in violation of the restrictions
established in paragraph A of this Section 2 to be towed from District Property,
as follows:
1.
Immediately, and without prior
notice, any vehicle parked or left unattended on any district Property may be
towed under the following circumstances:
a.
If a vehicle is in violation of
paragraph A(4) of this Section 2, which prohibits parking or leaving a vehicle
unattended unless the person parking or leaving the vehicle or a passenger in
such vehicle, is a participant or spectator in a District program or activity on
the premises where the vehicle is parked or left;
b.
If a vehicle is parked in such manner
that it creates an unsafe condition, partially or totally blocks, restrict or
impeded another vehicle, normal traffic flow, or ingress or egress to and from a
parking lot, road, driveway, sidewalk, doorway or recreational area;
or
c.
If a vehicle is parked or left
unattended in any posted “Tow-Away” zone on District
Property.
2.
In the event a vehicle is towed as
provided in this Section, it shall be impounded until the owner claims the
vehicle, and shall be released only after the owner or person responsible for
the vehicle has paid any towing cost due after the opportunity for a hearing as
provided in this subparagraph. The
following procedures shall be followed:
a.
The registered owner of the vehicle
shall be notified, by telephone if possible, but in any case by certified mail
or personal service, of the identity and location of the vehicle, the process
for requesting a hearing, and the fees and costs which must be paid to reclaim
the vehicle.
b.
If the registered owner of the
vehicle waives the right to a hearing, such owner shall be required to execute a
written statement of waiver, indicating that such owner was informed of the
right to a hearing, and ahs knowingly elected to waive such
right.
