DIVISION I CONSTRUCTION AND DEFINITIONS

SECTION 1. CONSTRUCTION AND SCOPE:

In the interpretation of this ordinance affecting parks, it's provisions shall be construed as follows:

  1. Any term in the singular shall include the plural.
  2. Any term in the masculine shall include the feminine and neuter.
  3. Any requirement or provisions of this Ordinance relating to any act shall respectively extend to and include the causing, procuring, aiding or abetting, directly or indirectly, of such act.
  4. No provision hereof shall make unlawful any act necessarily performed by any officer or employee of the District in line of duty or work as such or by any person, his agents, or employees, in the proper and necessary execution of the terms of any agreement with the Board, except when such act endangers or encroaches upon the rights of others as regulated by the laws of the Village of Westmont and the State of Illinois.

SECTION 2. DEFINITIONS

Unless otherwise expressly stated whenever used in this Ordinance.  The following terms shall respectively mean:

  1. "Board" shall mean the Board of Commissioners of the Westmont Park District, a Municipal Corporation, DuPage County, Illinois.
  2. "District" shall mean the Westmont Park District, a Municipal Corporation, DuPage County, Illinois.
  3. "Director" shall mean the Director of the Westmont Park District.
  4. "Dusk" shall mean one (1) hour after sunset.
  5. "Park" shall mean all developments, improvements, facilities and any or all land, minerals, waters, overhead air rights, easements and other reservations owned, leased, controlled, or used by the District.
  6. "Permit and Reservation" shall mean and include any authorization issued by the Director pursuant to the authority of the Board for a specified park privilege, activity or event, or permitting the performance of a specified act or acts in any Park.
  7. "Rules and Regulations" shall mean and include any resolution, regulation or ordinance adopted by the Board.
  8. "Person" shall mean any individual, company, partnership, corporation, incorporation or association, or any combination of individuals or gathering whatsoever.
  9. "Group" shall mean an assemblage of two or more persons.
  10. "Park Patrol" shall mean any person, agent, employee, patrolman, police officer or other law enforcement officer appointed or designated by the Board to enforce the rules and regulations adopted by the Board.
  11. "Vehicle" shall mean any device, conveyance, or combination of conveyances, wheeled or without wheels, propelled, towed or unpropelled that in, around or on which, a person or thing is or may be carried, including, but not limited to, bicycles, scooters, skateboards, mini‑bikes, motorcycles, snowmobiles, baby strollers, sleds, trucks and automobiles.
  12. "Alcoholic Liquor" shall be as defined in the Illinois Liquor Control Act, (235 ILCS 5/1‑3.05) as same is amended from time to time.
  13. "Controlled Substance" shall be as defined in the Illinois Controlled Substance Act (720 ILCS 570/102) as same is amended from time to time.
  14. "Property" where used shall mean all lands, developments, improvements, facilities, parks and equipment as owned, leased, controlled or used by the Park District.
  15. "Overnight" shall mean the period when the park, permit or facility officially closes or ends, until it opens the following day.
  16. "Area" shall mean a specified location within a park or facility.
  17. "Employee" shall mean any person on the payroll of the Westmont Park District, employed to perform special duties and tasks as described by personnel policy and the Board of Commissioners.
  18. "Waters" shall mean any waters or bodies of water as owned, leased or controlled by the Park District.
  19. "Watercraft" shall mean any type of conveyance, whether powered by sun, wind, mechanical or human energy, for travel upon waters.
  20. "Barbeque Grill" shall mean a fabricated metal container and grill designed for the cooking of food.

 

DIVISION II - REGULATION OF VEHICLES

SECTION 1. VEHICLE AND EQUIPMENT OPERATION & ACCESS

In connection with any park or property of the District:

  1. No person shall operate, or cause to be operated, any motorized vehicle which in any manner does not comply with the Vehicle Code of the State of Illinois, or other law or laws of the State of Illinois or ordinance of the Village of Westmont, Illinois, where applicable, together with such regulations as are contained in this ordinance and as from time to time amended, having to do with the equipment, control, licensing, registering, and use of motorized vehicles and/or the licensing of operators of such vehicles.
  2. No person shall operate or cause to be operated, any vehicle anywhere except on the roads, drives and parking areas within any park, in compliance with  Park District regulations and other applicable law.
  3. No person shall operate or cause to be operated in any park, any vehicle that is not properly licensed or permitted to be operated on the roads, streets and highways of the State of Illinois except in such cases as authorized by the Director, and then only in those areas specified and in accordance with  restrictions duly set forth by the Director.  Vehicles  subject to use in parks only as authorized by the Director include, but are not limited to, snowmobiles, go‑carts, trail bikes, mini‑bikes, and other such all‑terrain, off the road vehicles.

SECTION 2. PARKING REGULATIONS

No person shall, in connection with any park or property of the District:

  1. Park a vehicle anywhere except in specific areas as posted for parking of vehicles.  The Director shall determine posted parking areas.
  2. Park a vehicle anywhere overnight without a permit issued by the Director.  Any vehicle parked for 24 consecutive hours without a permit may be towed away at the owners expense.
  3. Park a vehicle in any manner at anytime as to partially or totally block, restrict or impede another parked vehicle, normal traffic flow, road, driveway, sidewalk, doorway, or recreational area.  The District shall have the right to tow away any vehicle in violation of this paragraph at the owner's expense.

SECTION 3. IMPROPER AND NEGLIGENT VEHICLE OPERATION

No person shall in connection with any park or property of the District:

  1. Operate a vehicle at a rate of speed or in any manner that is unreasonable or imprudent, not having regard to the traffic and use of the way, condition of the weather, visibility, condition of the way and other surrounding conditions, so as to endanger life or limb, or injure the property of any person.
  2. Operate a vehicle in such a manner as to deprive or unreasonably interfere with the equal right of any other person to the use of such public street or highway.
  3. Operate a vehicle in such a manner as to cause or produce unnecessary loud, raucous, excessive or unusual noise by racing of the motor, by lack of a muffler or use of a muffler cutout, by tire friction upon rapid turning or weaving, by spinning of the wheels from standing or slow moving position produced by sudden unnecessary motor acceleration, or by continuous sounding of a horn or other signal device.
  4. Operate a vehicle in disregard of any sign, signal, marking or device erected, constructed or created by the District or Director for the purposes of regulating, warning, or guiding traffic, or contrary to the order of direction of any police or park patrol officer or other person duly authorized by the District to direct or regulate traffic in the parks.
  5. Operate a vehicle and intentionally accelerate causing the rubber tires to spin, mark and deface the park or roadway surface.
  6. Operate a vehicle upon or in any park area, road, or drive which has been closed and posted with appropriate signs or barricades.  The Director shall have authority to order areas, roads or drives closed during the process of construction, reconstruction or repair.

SECTION 4. DRIVING UNDER THE INFLUENCE OF INTOXICATING LIQUOR AND / OR DRUGS

No person who is under the influence of intoxicating liquor, drugs, or a controlled substance shall drive, operate, or be in possession or control of, or attempt to drive or operate, any vehicle in any park or on any District property.

DIVISION III - PROTECTION OF PROPERTY, FACILITIES AND NATURAL RESOURCES

SECTION 1.  PROTECTION OF PROPERTY AND FACILITIES

No person shall in any park and with reference to any property of the District:

  1. Destroy, deface, paint, alter, change or remove any post, building, wall shelter, picnic table, bridge, pier, drain, well, foundation, washroom pump, athletic court and apparatus, telephone, lamp post, fence, gate, refuse container, exhibit, display, tool or equipment, storage box, utility outlet, movie screen, flagpole, playground structure or any other structure, park amenity, or parts thereof, without written permission of the Director.
  2. Deface, destroy, cover, damage or remove any placard, notice, or sign or parts thereof, whether permanent or temporary, posted or exhibited by the District to announce the rules, regulations and warnings, or any other information to the public necessary or desirable for the proper use of the park.
  3. Throw, carry, cast, drag, push or deposit in any refuse container, picnic table, barricade or any other movable or non‑movable property into the lake, pond, slough, stream, or lagoon or upon the frozen waters thereof, or to otherwise move, stack or hide such property in such a way as to render in unavailable to the general public for its intended use, or to cause a hazard to public safety or to damage or destroy such property.
  4. Enter into or upon any park or waters or area thereof or structure closed or posted against trespass, without written permission of the Director.  These structures or area may be, but are not limited to, employee residences and their immediate surrounding area, construction areas, work safety zones, equipment or material storage structures or area, work shops or stations, tree nurseries or areas undergoing intensive reforestation or other soil or vegetative treatment or area hazardous to public safety or health.
  5. Tamper with, or in any way weaken, destroy, damage remove anything from any park owned vehicles, machines, equipment, facilities or playgrounds.
  6. Bring into, leave behind, or dump any material of any kind, whether waste or otherwise, except refuse, ashes, garbage and other material arising from the normal use and enjoyment of a picnic or other permitted activity.  No bottles, cans, refuse, or foreign material of any description shall be deposited or thrown in any of the streams, waterways, ponds or lakes located in the parks.
  7. Remove any container or material from designated receptacles for the purpose of waste recycling.

SECTION 2. DESTRUCTION OR MISUSE OF NATURAL RESOURCES

No person shall in any park or with reference to any property of the District:

  1. Cut, remove, uproot or destroy any tree, sapling, seedling, bush, shrub, flower or plant, whether alive or dead, or chip, blaze, box, girdle, trim or otherwise deface or injure any tree, shrub or bush, or break or remove any branch or foliage thereof, or pick or gather any seed of any tree or other plant unless necessitated by the performance of restorative maintenance, or construction work as authorized by the Director or District.
  2. Remove or cause to be removed any sod, earth, humus, downed timber, wood chips, peat, rock, sand or gravel, or remove or cause to be removed any other natural material of the forest floor or earth unless necessitated by the performance of restorative, maintenance, or construction work as authorized by the Director or District.
  3. Hunt, pursue, trap, catch, capture, molest, poison, wound or kill or attempt to hunt, trap, catch, capture, molest poison, wound or kill any invertebrate animal, mammal, bird, reptile, or amphibian, disturb, molest or rob the next of any mammal, bird, insect, reptile or amphibian or the lair, den or burrow of any mammal, bird , reptile or amphibian, without the written permission of the Director and only in accordance with applicable law.
  4. Fish in any waters of the District posted against fishing, or by using a bow and arrow, spear or slingshot, or by using hooks baited with live or dead fish, amphibian, or bird or with any device using more than two hooks per line, or any net, seine, or trap, or with attended or unattended lines during the hours that parks are closed as defined by provisions of this ordinance or in violation of any applicable law of the State of Illinois or in violation of any regulations or restrictions as may be posted by the Director controlling the size, species, and number of fish that can be taken from a designated body of water.
  5. Release or cause to be released any wild, domestic, or pet animal, bird, fish, or reptile or bring in, plant, or distribute the seeds or spores of any flowering or non‑flowering plant brought into or upon park lands or waters from any outside source whatsoever, without written permission of the Director.
  6. Use or cause to be used any chemical or biological pesticide or any other substance, measure or process designed to alter the anatomy or physiology of any organism for the purpose of directly manipulating their populations without written permission of the Director, and then only in compliance with applicable law.
  7. Feed, harbor, or otherwise attract into a park any type of waterfowl, including ducks, geese, and sea gulls.
  8. Route any form of stormwater, runoff from sump pumps, or any other unnatural discharge of water onto District property without the written permission of the District and only in accordance with applicable law.
  9. Deposit, dump, throw, cast, lay or place, or cause to be deposited, dumped, thrown, cast, laid or placed, any ashes, trash, rubbish, paper, garbage, refuse, grass clippings, leaf waste, debris or junk.

SECTION 3. CONTRABAND

All animals, plants, birds, fish or reptiles, or parts thereof, killed, captured, trapped, taken or bought, sold or bartered, or had in possession contrary to any provisions of this ordinance or applicable law shall be and are hereby declared contraband and, as such, shall be subject to seizure by any police or park patrol officer or employee of the District.

SECTION 4. DESTRUCTION BY MISUSE OF FIRE

No person shall in any park or with reference to any property of the District:

  1. Set fire, or cause to be set on fire, any tree, forest, brushland grassland, meadow, prairie, marsh, refuse container or structure.
  2. Build a fire anywhere, for any purpose, except in provided fireplaces, or in approved receptacles as defined herein.
  3. Drop, throw away or scatter any burning, lighted or hot coals, ashes, cigarette, cigar, firecracker, or match.
  4. Cause, suffer, or allow the burning of garbage, refuse, waste material, trash, motor vehicle, or any part thereof, or other combustibles within the park so as to cause smoke, haze, odor, sparks, dust, dirt, or other type matter or gaseous substance to come upon, pass through, or over the park.

DIVISION IV - PERSONAL CONDUCT & BEHAVIOR

SECTION 1. DISORDERLY CONDUCT:

  1. DISTURBING THE PEACE
  2. No person shall in any park, engage in any disorderly conduct, or act in any manner so to disturb the peace within the park.  Loud playing of record players, televisions, radios, tape recorders, noisemakers, CD players, sound equipment, musical instruments, fighting, quarreling or wrangling with loud voice or shouts, use of profane or abusive language, threatening violence to the person or property of others, or engaging in riotous clamor or tumult are violations of this provision.  No person shall disturb or intrude upon a picnic or gathering in any park without consent of those composing the group, except for Park employees in the proper pursuit of their duties.

  3. ASSAULT & BODILY INJURY
  4. No person shall without lawful authority engage in conduct which places another in reasonable apprehension of receiving a battery, nor shall any person intentionally or knowingly without legal justification and by any means cause bodily harm to an individual or make physical contact of an insulting or provoking nature with an individual.

  5. BEGGING
  6. No person shall beg or solicit alms in any park.

  7. LOITERING
  8. No person or group of persons shall loiter in or near any building or other District structure, or loiter in or near a vehicle or vehicles within the park

SECTION 2. PUBLIC INDECENCY

No person shall commit, perform or engage in an act of public indecency, including but not limited to:

  1. An act of sexual intercourse.
  2. An act of deviate sexual conduct.
  3. A lewd exposure of the body done with intent to arouse or satisfy the sexual desire of that person.
  4. A lewd fondling or caress of the body of another person of either sex.

SECTION 3. SOLICITING/VENDING/ADVERTISING

  1. No person shall offer or exchange for sale any article of merchandise or food or do any banking, peddling, or solicitation, or buy or offer to buy any article of merchandise or food or take up any collection or solicit or receive contributions of money or articles of value, except when authorized by permit or under contract with the District.
  2. No person shall display, distribute, post, or fix any type of placard, sign, pamphlet, or other printed material containing advertising or other material whatsoever, except for groups holding a valid picnic or special event that may have identification and direction signs, provided they are temporary and removed at the end of the activity, and are not attached to any tree, post, fence, building or other District structure.

SECTION 4. GAMBLING:

No person shall engage in any game of chance or in the use of any gambling device, nor shall any person tell fortunes for pecuniary reward, except for special events with written permission of the Board.

SECTION 5. FIREARMS, WEAPONS, EXPLOSIVES, AND MISSILES:

  1. No person except Park Patrol or other law enforcement officers in the line of duty, shall have, carry, or discharge any gun, pistol or shotgun in any park or upon District property.  At no time shall anyone carry or discharge any switchblade, hunting knife, dagger, metal knuckles, chain, slingshot, blowgun, bow & arrow, any potentially dangerous lethal instrument, harmful solid, liquid aquenous, effervescent, gaseous substance or other dangerous weapon concealed on or about his person while within any park or upon District property.
  2. No person shall throw or cast any stones or other missiles, or any class of fireworks, sparkler, or smoke device in any park.

SECTION 6. USE OF FACILITIES RESTRICTED BY SEX:

No person, except for children under 4 years of age, shall enter or remain in any toilet, locker room, restroom, or other structure which has been designated by the District for use of the opposite sex.

SECTION 7. UNLAWFUL TRESPASS /CONSTRUCTION:

  1. No person shall trespass or remain in any park past the established closing time or the end of any approved activities therein as established by the District.
  2. No person shall trespass anywhere on the Twin Lakes Golf Club at anytime, except for those persons paying the designated fee and complying with golf course rules and regulations as specified in Appendix III.
  3. No person shall erect, construct, install or maintain any structure on, below, over, or across any park or District property, except as permitted in writing by the District or the Director and specifying work to be done and conditions pursuant to the terms of such permit.

SECTION 8. ALCOHOL, DRUGS AND SMOKING

  1. No person shall remain in any park or upon District property, while under the influence of any liquor, beer, drug, narcotic or controlled substance nor shall any person while in any park or upon District property,  possess, give away, sell, serve, dispense, or drink, possess, sell, deliver, smoke, inhale, inject, eat, chew or swallow any alcoholic beverage, narcotic, drug, or controlled substance.  The sale of beer and wine purchased on the premises of Twin Lakes Golf Club or Health Core and consumed thereon, or special activities defined and regulated in Appendix I, are excepted from the prohibitions of this paragraph.
  2. No person shall smoke cigarettes, cigars or pipe tobacco in any indoor facility of the District except in designated smoking areas of the Golf Course Club House and in compliance with the Clean Air Act.

SECTION 9. CONTROL AND TREATMENT OF ANIMALS & PETS

Pets shall not be permitted in any park or upon District property unless approved by the Director.  Any pet in a park or on District property in violation of this section, may be removed from the park and the owner or person in control of such pet at that time shall pay any costs associated from the shelter or pound where such animal or pet is taken, in addition to any other fine or penalty provided by law.

DIVISION V - REGULATIONS OF SPORTS, GAMES AND LEISURE ACTIVITIES

SECTION 1. AVIATION AND AIRSPACE

No person shall voluntarily bring, land, or cause to descend or alight upon park lands or waters any airplane, flying machine, balloon, parachute or other apparatus for aviation, except by written permit of the District or Director.  Any landing other than one caused by mechanical or structural failure of the aircraft or any of its parts, shall be deemed to have been made voluntarily.

SECTION 2. WATERCRAFT

  1. No person shall bring into, attempt to launch, or use, or navigate, any type of watercraft upon any Park District waters, except as allowed by permit and regulations thereof by the Director.
  2. Where allowed by permit, watercraft shall not have any electrical or motor driven propellants, and shall be operated in a safe manner in accordance with restrictions as may be set forth in such permit.
  3. No watercraft may be moored or beached upon Park District land unless expressly stated by permit.

SECTION 3. SWIMMING

No person shall swim, wade or bathe at any time in any natural or man‑made body of water in any park.

SECTION 4. WINTER SPORTS

  1. ICE SKATING
  2. No person shall skate, ski or slide on any natural or man‑made bodies of water, except those areas designated for such purpose and then only in compliance with rules and regulations for such use.

  3. SLEDDING
  4. No person shall sled, slide or toboggan in any areas except those designated for such purpose, and then only upon proper snow cover or as other environmental conditions allow and as allowed by posted notice from the Director.

  5. SKIING
  6. No person shall downhill ski in any park at any time.  Cross country skiing is allowed in any park only in areas not otherwise restricted by the District or Director.

  7. ICE FISHING
  8. No person shall ice fish on any natural or man‑made body of water in any park.

  9. SNOWMOBILING
  10. No person shall ride or operate any snowmobile or other self‑propelled vehicle designed for travel on snow covered ground at any time in any park, unless authorized to do so by the Director.

  11. OTHER VEHICLES
  12. No person shall bring onto or operate upon any frozen waters in any park, any iceboat or other wind‑driven device at any time.

SECTION 5. POWER MODELS, TOYS AND MODEL ROCKETRY

  1. No person shall start, ignite, fly, or use any fuel powered model, aircraft or rocket in any park areas except in areas designated for such use by the District or Director.
  2. Model boats and cars shall be permitted only in non-pedestrian or otherwise non‑restricted areas and cannot be powered by any combustible fuel engine.

SECTION 6. EQUESTRIAN USE:

No person, without a permit from the Director, shall bring into, ride upon, unload or use any horse or pony in any park.

SECTION 7.  FIELD AND TEAM SPORTS

  1. No person shall play or engage in any team sport or game such as, but not limited to, baseball, football, soccer, volleyball, horseshoes, or softball, except in those park areas designated for use as athletic fields, and only in such a manner as to not interfere with other persons using said athletic areas, and under such rules and regulations as may be prescribed by the Director, and as stated in Appendix II.
  2. No person shall use lighted athletic fields past the hours as following:  Little League Field - 10:30 P.M.; Babe Ruth and Softball Fields - 11:00 P.M.; and Blackhawk Park - 10:00 P.M.

SECTION 8. GOLFING

No person shall possess, swing, or make use of any golf club to hit or putt golf balls within or into any park, except on any established District golf course or driving range, and then only in accordance with the rules, regulations and fees therefor as established in Appendix III.

SECTION 9. BICYCLES AND SKATEBOARDS

  1. No person shall ride a bicycle or skateboard on any path, trail, roadway, athletic field, spectator area, public areas, or other area designated and posted by the District or Director as prohibiting bicycles or skateboards or both.
  2. No person shall carry another person on the handlebars, frame, fender or so ride a bicycle except on a suitable seat attached thereto for such a purpose, or operate a bicycle in a reckless manner so as to endanger pedestrians, the rider, or riders thereon.
  3. No person shall park or leave unattended any bicycle so to impede,  travel upon or block any pedestrian or vehicular traffic or access way in any park.
  4. No person shall be permitted to rollerskate or rollerblade on any athletic court, except in those areas designated for such use by the District or Director.

SECTION 10. METAL DETECTORS

No person shall possess, use, or operate any type device intended for locating buried objects in the parks, except with a permit from the Director.

SECTION 11. FIREARMS, WEAPONRY AND EXPLOSIVES

  1. No person shall use a bow and arrow of any kind in any park.
  2. No person shall use a shotgun, rifle, pistol or other type of firearm, for shooting in any park including, but not limited to, skeet, trap or target shooting.
  3. No person shall possess, ignite or use any type of firecracker, sparkler, explosive or other pyrotechnic device in any park.

SECTION 12. FISHING

Fishing shall be permitted in District ponds, watercourses and other waters in accordance with applicable law except those waters on the Twin Lakes Golf Club, or other waters as posted to be restricted by the Director.

SECTION 13. CAMPING & SLEEPING IN PARKS

  1. No person shall camp within any park except in areas as may from time to time be designated by the Board or upon written approval of the Director.
  2. No person shall sleep in any park between dusk and sunrise the following day, except in designated camping areas as aforesaid.

SECTION 14. PICNICS & PARK RESERVATIONS

  1. Picnics shall be permitted only in areas designed or designated therefore and during the regular open hours of that park.
  2. Picnic and park areas may be reserved for use by resident groups following the rules and regulations duly set forth in Appendix I.
  3. No person shall use the area in any park being used by a group  having a valid park reservation permit, except with permission of the group.

SECTION 15. FIRES AND BARBEQUES

  1. No person shall ignite, tend, or maintain any open fire in any park.
  2. Barbeques and cookouts shall be permitted only in a barbeque grill or District provided fireplace, and provided that materials used to burn therein are not taken live from the park, and further provided that the cooking fire is maintained  without the emission of dense smoke, sparks, odor, dust, or ash, and properly extinguished after use.  A fire shall be deemed properly extinguished when ashes, residue, coals and unburned substances are cold to human touch.
  3. The dumping of hot ashes or fire from a portable barbeque grill onto the grass or plants is prohibited.  Hot ashes shall be deposited only in specified areas or designated receptacles, but not in picnic refuse receptacles.

SECTION 16. PARK HOURS

No person shall be on or in any park between dusk and 6:00 A.M. of the following day unless in attendance of a District event.

DIVISION VI  ENFORCEMENT

SECTION 1. AUTHORITY

All District personnel, Park Patrol and members of the Board of Commissioners are authorized to, without the use of force, detain or eject from any facility or park, any person found in the act of violating any applicable District rule, regulation or ordinance.

SECTION 2. AUTHORITY OF OTHER AGENCIES OR PERSONS

  1. The Westmont Police Department has the power and is authorized to arrest or eject from any park or facility any person found in the act of violating any ordinance of the District, ordinance of the Village of Westmont, or law of the State of Illinois.
  2. Nothing in this ordinance shall be construed to prevent other law enforcement officials from carrying out their duties in accordance with applicable law within the District and its parks.
  3. The District may appoint and assign Park Patrol officers to  supervise and enforce park regulations and ordinances in the parks.

SECTION 3. FINES AND PENALTIES

For each violation of any of the provisions of this ordinance or for each day that a violation continues, a fine shall be imposed upon the violator being found guilty thereof by a court of competent jurisdiction, in an amount of not less than $50.00 nor more than $200.00 and court costs.  Restitution may be required by the court in appropriate cases.

SECTION 4. RULES AND REGULATIONS:

The Director may from time to time, promulgate reasonable rules and regulations governing the use of the various areas, facilities, devices and vehicles within the parks, which would include appendixes I, II, and III, approved herewith and incorporated herein, and such rules and regulations shall become binding and effective upon their being approved by the Park Board of Commissioners and posted at the entrance to the facility or areas governed by them and shall be enforced with the same force and effect as the other provisions of this ordinance.

APPENDIX I
PERMITS AND REGULATIONS

SECTION 1. AUTHORITY

To carry out the terms of this ordinance, the Director is hereby authorized to issue permits, post notices, or take any other action as required hereby, subject to the guidelines hereinafter set forth.

  1. The Director shall have the authority to designate areas, facilities, or waters, suitable for various activities or use, to close parks, or parts thereof, in the interest of public health, safety or general welfare or in order to protect the natural resources from unreasonable harm and to promulgate and issue permits where required by this ordinance and collect such fees as established by the District in accordance with the following guidelines:
    1. That no person be discriminated against because of race, sex, creed, color or national origin.
    2. That the proposed use or activity will not reasonably interfere with or detract from the general public's use and enjoyment of the park and surrounding property or facilities.
    3. That the proposed use or activity is not reasonably likely to result in violence or in serious harm to property or persons.
    4. That the proposed activity or use will not entail extraordinary expense or operation costs by the District or expose it to unusual or extreme liability.
    5. That the area desired has not been reserved for another activity at the same time.
    6. That the proposed activity is not reasonably expected to detract from the promotion of public health.
    7. That the proposed activity is reasonably compatible with the type of park, size and character of the area or waters involved and the facilities available and that it is not reasonably expected to cause irreparable harm or damage to the natural environment of the park.
  2. The Director may impose reasonable restrictions in granting of a permit including, but not limited to, any of the following:
    1. Restricting the open dates for reserved area use, the length of time an area will be held for reserved use, the use of ground fires, sound and energy amplification devices, amusement devices, off the road vehicle access, the number of persons present, location and type of any tents, bandstands, stages, or temporary structures, the use of domestic, pet or trained animals, the use of shelters or structures, the collecting for any purpose of any water, soils, minerals, flora and fauna, the type and location of sports and games, or any other activity which appears likely to create a risk of unreasonable harm to the use and enjoyment of the park by others or of damage to District property.
    2. Restricting park reservations to resident groups of the District or Village of Westmont.
    3. Requiring proof of and establishing the amount of liability insurance required, and requiring a hold harmless agreement, and requiring a certificate of insurance naming the District as an additional insured when the activity is deemed by the Director to require such.
    4. Requiring the name, address, telephone number and driver license number of a legal adult responsible for the use of activity requested as well as name, address and telephone number of the group represented by the applicant.
    5. Requiring that the applicant furnish additional approved security personnel at the applicant's expense, such personnel to act in accordance with requirements determined by the District or Director.
  3. All permits required by this ordinance or issued by the Director shall be delivered at the Community Center office in Westmont, on a first-come, first-served basis beginning the first working day of each calendar year. All applications for permits shall be submitted at least 72 hours in advance of the earliest requested date, provided that the Director may waive the 72 hour time period in the interest of public health or safety or for such events that are of a significant civic nature.
  4. The Director is authorized to seek reasonable information regarding any proposed use, activity or privilege and require a record of such information on a permit application.
  5. No person shall misrepresent, falsify or withhold such required information.
  6. No person granted a permit shall violate the requirements, terms, conditions, restrictions or rules duly set forth under the authority of this ordinance as part of any granted permit or registration.
  7. The Board of Commissioners of the District may set forth in other ordinances such permit or registration fees as it deems proper and may change them from time to time.
  8. No person shall obtain or use any permit without first having paid the fee established by ordinance for such permit.
  9. All designated areas, waters or facilities and all permit restrictions, rules and regulations, or conditions are subject to review at any time by the District or Director.  Any aggrieved person shall have the right to petition the Board of Park Commissioners, in writing, regarding denial or restriction of use or activity and such petition shall be heard by the Board as the President shall direct.

SECTION 2. ACTIVITIES REGULATED BY PERMIT

  1. No person shall conduct, operate, present, manage or take part in the following activities in a park unless a permit for that activity is obtained from the Director prior to the start of the activity, and the activity is otherwise conducted in conformity with applicable laws, rules and regulations.
    1. Any contest, show, exhibit, dramatic performance, play act, motion picture, acrobatic feat, bazaar, sporting event, ceremony, children's day camp or any public meeting, assembly or parade, including but not limited to, drills and maneuvers, rallies, picketing, speeches and addresses, marches or political meetings.
    2. Selling, distributing or consuming alcoholic beverages.
    3. Any use of any park or facility by a certain person or group of persons to the exclusion of others.
    4. Camping on lands of the District or inhabiting any structure or facility overnight.
  2. Permits required under this ordinance shall be issued only on the basis of reasonable time, place and manner, considerations, and with specific reference to the general welfare of the District and it's parks and property.
  3. Persons desiring that any of the above activities be conducted in any District park, may apply to the Director for a permit under the following categories and subject to payment of fees as set by the District.
    1. Picnic:  No permit is required to have a picnic; however, if a person desires to reserve a designated area or areas to the exclusion of others or desires to conduct in conjunction with the picnic related, controlled activities such as, but not limited to sound amplification, alcohol, special vehicle access, animal rides and the like, then a picnic permit, valid for one day, is required.
    2. Camping:  The required permit reserves a designated area or areas to the exclusion of others and allows permitted to remain in the park overnight.
    3. Special Event:  A permit is required for any of the other activities listed in paragraph A. 2 above.  The permit may be valid for from 1 to 7 consecutive days.  The permit may provide for us of an area or areas to the exclusion of others and for other activities requiring a permit pursuant to this ordinance. 
    4. Athletic Fields:  During the months of April through August, written permission must be obtained from the Westmont Youth Baseball Association for exclusive use of baseball fields; at all other times, the WYBA shall have priority use of all fields.
  4. Permits for Alcoholic Beverages:
    1. Beer and wine may be served, not sold, unless by special permit issued by the Director upon approval of the Board of Park Commissioners, and only in those areas of certain parks as specified in paragraph 5 hereinafter.  No hard alcohol is allowed in parks and facilities at any time.  No glass containers are allowed at any time.
    2. Permittee will provide the District with a detailed outline of planned activities including, but not limited to, times of the event, procedures to control underage drinking, site layout, purpose of outing, and 3 names of individuals responsible for activity.
    3. All permits and necessary insurance information must be filed for approval by the Board a minimum of 30 days prior to the event.
    4. Required permits and insurance shall include the following:
      1. Any group wishing alcohol privileges must provide adequate insurance as determined by the Director, and must name the District as an additional insured.
      2. In addition to a District permit, a temporary liquor license may be required by the Village of Westmont, all at the expense of the permittee.
    5. Beer and wine are allowed by permit in Veterans Memorial Park and Lions Park ONLY.  Lions Park is available for groups under 50 only.  Any group larger than 75 people may be required to provide police security at their own expense.  Beer and wine must be confined to the picnic grove at Veterans Memorial Park, and the shelter at Lions Park ONLY.
  5. Permits are not transferable and fees paid are not refundable.  Permits must be applied for at least 72 hours in advance of event.  Minor changes in the permit may be made upon written permission of the Director for no additional fee providing that the specific park or area designated is not changed, the date or date involved are not changed, the number of designated person is not increased and the request for the change is made at least 72 hours prior to the event.  Permits may also be required for other activities as determined by the Director.
  6. Permit fees shall be as follows:
    1. Parks and Facilities: Resident groups may reserve parks and facilities for a minimum fee of $15.00.  This fee will be determined by the Director depending upon the size of group and location of the activity.  This fee shall cover the cost of additional cleanup, staffing and maintenance costs.
    2. Deposits: Groups 50 - 100 people:  $25.00
      Groups of 100 + people :  $50.00
      A maintenance report by crews or Park Patrol will be submitted to the Community Center for deposit validation.  Deposits will be returned only upon satisfactory condition (garbage picked up, no vandalism or broken equipment) and a verified maintenance report.
    3. Ballfield Lights: Lights may be rented by residents only for any athletic area that is available (Little League, Babe Ruth, Blackhawk, Twin Lakes) from May 10 - August 7.  From August 7 to October 7, lights may be rented at Twin Lakes Park, Blackhawk, and the Babe Ruth field.  The fee shall be a flat rate of $50 per night.
    4. Picnic Packs: There are 2 packs available.
      Fees:  Residents Only - $2 per weekday
      $5 per weekend (Fri. p.m. to Mon. a.m.)
    5. Deposits: A deposit of $25 is required and upon the return of the equipment in good order, the $25.00 will be refunded within 10 days to 2 weeks.  People may call in advance for reservations.

SECTION 3.  COMMUNITY CENTER REQUEST INFORMATION

It is the intent of the District to make its facilities available to the public on a fair and equitable basis.  The following procedures, guidelines and fee schedule will outline the procedures in regard to usage of facilities and resources.

  1. Facility request procedures are as follows:
    1. Facility requests may be made in writing or in person at the Westmont Park District Community Center, 75 E. Richmond Street, Westmont, Il. 60559.
    2. Requests should be made at least one (1) month in advance of the activity.  Requests should be signed by an adult who assumes responsibility for the activity.
    3. Facilities are assigned in the following priority order:
      1. Park District programs
      2. Park District sponsored programs
      3. Not-for-profit groups and organizations with more than 50% residents of the Westmont Park District.
      4. Private individuals or organizations from within the boundaries of the Westmont Park District.
      5. Not-for-profit groups and organizations with less than 50% residents of the Westmont Park District
  2. Fees and charges are as follows:
    1. Fees are based on the facility, time and type of group or organization requesting the facility.
    2. Basic building hours, 8 a.m. to 10 p.m., Mon through Fri., 8 a.m. to 4:30 p.m., Sat. and Sun.
    3. Refunds for cancellation will not be given if requested less than 48 hours prior to the rental.  A $10.00 administrative charge will be assessed for all refunds.
    4. All fees are payable in full seven (7) days prior to the scheduled rental
  3. Rental rates and categories are as follows:
    Categories:
    1. Not-for-profit groups or organizations with a minimum of 50% of it's members being from within the District.
    2. Private individuals or organizations residing or located within the District.
    3. Not-for-profit groups or organizations with less than 50% of it's members or participants being residents of the District.
    4. Private individuals or organizations residing or located outside the District.
                  

Any group of more than 75 is required to pay an additional $5.00 per hr. for an extra supervisor from the District.  Any rental that is scheduled at a time where a regular supervisor is not on duty must pay an additional $10.00 per hour custodial fee.  All groups renting the kitchen must leave a $25.00 deposit.

APPENDIX II
SPORTS CONDUCT & REGULATIONS

SECTION 1. SCOPE

These regulations shall govern individuals in all athletic activities operating within the jurisdiction of the Westmont Park District whether in organized activities of the Park District, or using Park District facilities with or without the District's permission.

SECTION 2.  PROHIBITED ACTIONS & BEHAVIOR

No person shall, in connection with any athletic activities:

  1. Behave in any manner which is of an insulting, provoking, abusive, or physically intimidating manner toward any other person.  The athletic director of the District shall have the discretion to determine whether any individual has acted in such a manner after duly investigating the facts and circumstances of the alleged situation.  The decision to impose the sanctions provided herein will be in the sole discretion of the athletic director subject only to the individual's right to appeal.
  2. Consume, possess, or be under the influence of any type of alcoholic beverage, or narcotic, or illegal drug while in any park.
  3. Use abusive, profane or other provoking language to other players, officials, or spectators.
  4. Park in the parking lot south of the ballfield at Twin Lakes Park, that lot being for apartment residents only.  Parking for softball is allowed along the north side of the street, the first row only of the apartment parking lot, and the parking lot east of the field.  Illegal parking in the apartment complex parking lot may result in a fine and towing of the vehicle.

 

SECTION 3.  PENALTIES AND SANCTIONS

  1. Profanity:
    The umpires and league supervisor are empowered to eject from the game or ballfield area any player or team representative using profanity.
  2. Alcoholic Beverages:
    1. A player discovered in possession of, or drinking alcoholic beverages or substances, will be suspended according to policies as outlined in this section.
    2. Spectators may be removed from the park if in possession of alcohol in the park.
  3. Prohibited Physical Contact:
    The athletic director shall impose upon any individual who has committed prohibited physical contact with another individual an immediate banishment of that individual from the use of the District's athletic facilities for a twelve month period.  An individual's right to resume participation in District activities or use of its facilities thereafter shall be permitted only upon request to do so directed to the Board of Park Commissioners, and approval for reinstatement from the Board as provided hereinafter.
  4. Other Prohibited Conduct:
    With regard to any other type of prohibited conduct as previously described, the athletic director shall have the right to suspend such individual for a period of 2 games if the individual is a participant in an organized league, or for a period of 2 weeks if the individual was using the general facilities of the District.  At the end of such period in either case, the individual's right to resume participation or usage shall be automatic.  Any participant or individual who is a repeated violator of the standards of conduct set forth in this regulation may be subjected to repeated and extended suspensions of participation in programs or use of the District's facilities in the discretion of the Director or Board of Park Commissioners.
  5. Forfeits:
    A $20.00 fee will be charged on the second team forfeit.  This fee must be paid prior to the next game or season for that team to participate.  A third forfeit will result in the team's expulsion from the league.  No refund will be issued to any such team.  That team will also be ineligible for participation the following season.  Any team forfeiting out of the league will result in the nullification of all games played or games scheduled to be played in the regular season.      

SECTION 4.  PROTESTS

Protests on rules must be made to the referee at the time of the alleged violation and must be followed thereafter by a written protest before the end of the next working day.  Captains of both teams must be notified of the protest.  No protests will be allowed if the protesting captain refuses to play out the game.  Protests will be decided by the athletic coordinator and football officials, and that decision shall be final without any appeal therefrom.  A $25 fee (refundable if the protest is upheld) must accompany the written protest.  The team captain must include a full written description of the situation, and must cite all pertinent rules.

SECTION 5.  APPEALS

  1. Any participant or individual who is sanctioned as a result of a violation of this appendix, except as an appeal may be expressly prohibited herein, shall have the right to appeal to the Board of Park Commissioners at any regular meeting of the Board by contacting the director of athletics with a request to be put on the Park Board's agenda for a specific meeting at least 14 days in advance thereof.
  2. At such meeting, the individual shall be entitled to present his version of the facts  and thereafter the Board of Park Commissioners will notify him  of its decision of his appeal.
  3. The Board of Park Commissioner's decision is final without any further appeal or rehearing by the Board.

SECTION 6. REINSTATEMENT

Upon the completion of the period of banishment of any individual who is required to seek permission of the Board of Park Commissioners to be allowed to resume participation in the programs of the District or the use of its facilities as provided herein, such individual must apply to the Board of Park Commissioners using the same process as is set forth herein for appeal.  The right of the Park Board to make the final determination shall be absolute and shall be made with due regard for the safety and welfare of the Park District's participants and facility users who may come into contact with the individual.  The Board shall be able to receive any and all evidence and recommendation of its staff, witnesses, and participants in making its final determination. 


APPENDIX III

WESTMONT PARK DISTRICT
TWIN LAKES GOLF CLUB

RULES AND REGULATIONS

  1. All full time staff of the District, golf superintendent, pro shop workers, and golf course staff shall be agents of the director of parks and recreation for the District and shall enforce all rules and regulations pertaining to golf.
  2. Each golfer must pay the required green fee.
  3. Golfers on weekends, holidays and busy weekdays may be required to play in foursomes assigned by the staff.
  4. Children under 11 years of age must be accompanied on the course by a responsible adult.
  5. The director's agents may remove a golfer, or golfers from the golf course for flagrant violation of course rules or golf etiquette (e.g., obnoxious behavior, intoxication, damaging of course, refusal to let people through while holding up play, or failure to follow course design on a hole-to-hole basis.)
  6. Trespassers, dog walkers, bicycle riders, picnickers or any other unauthorized person shall not be permitted to walk, ride, or rest on golf course premises.
  7. No person shall submit false information for the purpose of securing golfing privileges.
  8. There will be no tee time reservations for daily green fees.  Reservations will only be granted for recognized league or tournament play.
  9. Tournaments and leagues may be scheduled on Twin Lakes Golf Club according to applicable rules and regulations.
  10. Five or more players playing together are not allowed without permission of the director of parks and recreation.
  11. No person shall play the golf course after the course has been closed by the District because of weather or certain maintenance practices.
  12. Twin Lakes Golf Club will open for season play from March through Thanksgiving weekend.  This is subject to weather and condition of the golf course.
  13. Only one (1) ball can be played per hole per person.
  14. The acceptable rate of play for 9 holes is 2 hours.
  15. All ball marks and divots must be repaired by player and all bunkers must be raked.
  16. Scores shall be marked on the player's card only on next tee or thereafter.
